Περίληψη
Στην εργασία αυτή εξετάζεται η δικονομική θέση του παθόντος στην ποινική διαδικασία. Η ανάλυση εκκινεί από την ιστορική εξέλιξη των σχετικών δικαιωμάτων τόσο στο αγγλοσαξονικό δίκαιο (Ηνωμένο Βασίλειο και Ηνωμένες Πολιτείες) όσο και στο ηπειρωτικό δίκαιο (Γαλλία και γερμανικός χώρος). Η ανάλυση διακρίνεται χρονικά σε δύο περιόδους, με τον Β’ Παγκόσμιο Πόλεμο να αποτελεί το ορόσημο για τον επαναπροσδιορισμό του ρόλου του θύματος. Ακολούθως παρουσιάζονται οι νομοθετικές πρωτοβουλίες του ενωσιακού νομοθέτη σχετικά με την κατοχύρωση των δικαιωμάτων και την προστασία των θυμάτων. Παρουσιάζεται εκτενώς η απόφαση-πλαίσιο 2001/220 σχετικά με το καθεστώς των θυμάτων σε ποινικές διαδικασίες καθώς και οι σχετικές αποφάσεις του ΔΕΕ. Ακολούθως, μνεία γίνεται στην Οδηγία 2004/80 για την αποζημίωση των θυμάτων εγκληματικών πράξεων και στην Ελληνική Αρχή Αποζημιώσεως. Η επίδραση της Συνθήκης τηλίου Πλημμελειοδικών όσο και του Συμβουλίου Εφετών και του Συμβουλίου του Αρείου Πάγου. Αναλύονται δε και τα δικαιώματα του υποστηρίζοντος την κατηγορία στις εναλλακτικές διαδικασίες. Ειδικότερα, μελετάται ο ρόλος του παθόντος στη διαδικασία της αποχής από την ποινική δίωξη, αποχής από την ποινική δίωξη πλημμελημάτων υπό όρους, αποχής από την ποινική δίωξη κακουργημάτων υπό όρους, αποχής μετά από εντελή ικανοποίηση, ποινικής συνδιαλλαγής και ποινικής διαπραγμάτευσης. Επιπροσθέτως, παρουσιάζονται και ερευνώνται τα δικαιώματα του υποστηρίζοντος την κατηγορία στην επ’ ακροατηρίω διαδικασία, που αφορούν στην κλήτευση και εξέταση μαρτύρων, τη διεξαγωγή της δίκης κεκλεισμένων των θυρών, την αναβολή και διακοπή της δίκης. Περιγράφονται, ακόμη, ειδικότερα δικαιώματα που απορρέουν από την κατ’ αντιδικία διεξαγωγή της κύριας διαδικασίας και το δικαίωμα αποδείξεως του υποστηρίζοντος την κατηγορία. Τέλος, παρατίθενται προβληματισμοί σχετικά με τα διαθέσιμα μέσα θεραπείας των παραβιάσεων των δικαιωμάτων που περιγράφησαν.

The scope of this thesis concerns the procedural rights of the victims in criminal proceedings. The analysis begins from the historical evolution of the relevant rights in the United States and the United Kingdom as well as in France and German States before and after World War II that constituted a turning point for victim’s rights. Subsequently, the legislative initiatives at the EU level are presented. Framework Decision 2001/2020 on the status of victims in criminal proceedings and relevant CJEU’s decisions are presented in detail. Moreover, reference is made to the Directive 2004/80 relating to compensation to crime victims and to the Hellenic Compensation Authority. The analysis includes among others the right to understand and to be understood, the victim’s right when making a complaint, the right to receive information, the right to translation and interpretation, the right to be heard, rights in the event of a decision not to prosecute, the right to legal aid as well as rights in the context of restorative justice services and the right to protection. The relevant case-law of the CJEU is presented alongside Directive 2011/36, Directive 2011/93, and Directive 2017/541.Securing the rights of the victims through ECtHR’s case law also constitutes an important aspect of this thesis. In this context, positive obligations are analysed (articles 2,3,4, and 14 ECHR) and examined in detail through case-law. Moreover, the scope of article 6 ECHR relating to victims is specified and the specific rights arising from case-law are presented. The effort of the ECtHR’s to balance in the framework of article 6 ECHR the rights of the accused with the rights of the victims is also addressed. Lastly, the ECtHR’s case-law is compared to the European legislative framework. The analysis of the victims’ status in Greek criminal proceedings begins with the Code of Criminal Procedure of 1834. The Code of 1951 is also mentioned. Furthermore, the incorporation of Directive 2012/29 into national law with Law 4478/2017 is presented. Victim’s rights in the Code of Criminal Procedure are thoroughly analysed throughout all the stages of the proceedings. Finally, there are some remarks relating to the available remedies in case of violations of the rights described.
