Restorative justice and crime in Greece: the attitudes of Greek magistrates

Abstract

Restorative justice and mediation techniques are applied in Greece for many centuries and in different historical phases, as they are in harmony with the Greek legal tradition and the lenient attitude underlying the latter. However, it must not be overlooked that in Greece, as in other European countries, the state monopolizes the answer against crime. Statutory legal proceedings regarding reconciliation are built and operate within the formal criminal justice system. Moreover, developments in the field of restorative justice take place under the exclusive management of the state, while the role of the mediator is institutionally assigned to prosecutors. On the other hand, a prerequisite for the new practices to operate effectively, is the active involvement and participation of both stakeholders involved in a criminal act, and community members as well.
