Le statut juridique du demandeur d'asile en droit international et européen

Abstract

The term "asylum seeker" is usually employed to designate, often descriptively, a person seeking certain predefined types of international protection. The person in question is viewed through the prism of refugee status as a "candidate-refugee" or assimilated to other migrants deprived of international legal status. This thesis asks whether, in the current state of positive law, there is a legal category, capable of encompassing all persons seeking international protection, regardless of the type of international protection sought, and making it possible to recognize an autonomous protection status for them, better suited to the particularities of their situation. The evolution of the concept of "international protection" through the interaction between the different existing protection regimes for the individual means that the search for asylum can be disconnected from refugee status and that a functional rather than formal view can be adopted in this field. This paves the way for an autonomous conceptual approach of the asylum seeker and for the elaboration of his/her own legal status.

Ο όρος "αιτών άσυλο" χρησιμοποιείται συνήθως για να προσδιορίσει, συχνά περιγραφικά, ένα άτομο που αναζητά ορισμένους προκαθορισμένους τύπους διεθνούς προστασίας. Το εν λόγω άτομο προσεγγίζεται υπό το πρίσμα του καθεστώτος του πρόσφυγα ως "υποψήφιος-πρόσφυγας" ή εξομοιώνεται με άλλους μετανάστες που στερούνται διεθνούς νομικού καθεστώτος. Η παρούσα διατριβή διερωτάται εάν υπάρχει στο θετικό δίκαιο μια αυτοτελής νομική κατηγορία ικανή να συμπεριλάβει όλα τα πρόσωπα που αιτούνται διεθνή προστασία, ανεξαρτήτως του είδους της ζητούμενης διεθνούς προστασίας και να καταστήσει δυνατή την αναγνώριση ενός αυτόνομου καθεστώτος προστασίας γι' αυτά, που να ανταποκρίνεται καλύτερα στις ιδιαιτερότητες της κατάστασής τους. Η εξέλιξη της έννοιας της "διεθνούς προστασίας" μέσω της αλληλεπίδρασης μεταξύ των διαφόρων συστημάτων κανόνων προστασίας του ατόμου σημαίνει ότι η αναζήτηση ασύλου μπορεί να αποσυνδεθεί από το καθεστώς του πρόσφυγα και ότι μπορεί να υιοθετηθεί μια λειτουργική και όχι τυπική προσέγγιση στον τομέα αυτό. Αυτό ανοίγει το δρόμο για μια αυτόνομη εννοιολογική θεώρηση του αιτούντος άσυλο και για την ανάπτυξη του δικού του αυτοτελούς νομικού καθεστώτος.

Le terme « demandeur d’asile » est habituellement employé pour désigner, souvent à titre descriptif, une personne à la recherche de certains types de protection internationale prédéfinis. La personne en question est appréhendée sous le prisme du statut de réfugié en tant que « candidat-réfugié » ou assimilée aux autres migrants dépourvus de statut juridique. Le présent ouvrage invite à s’interroger sur l’existence, en l’état actuel du droit positif, d’une catégorie juridique à part entière susceptible d’englober l’intégralité des personnes à la recherche de protection internationale, indépendamment du type de protection recherchée et permettant de reconnaitre dans leur chef un statut de protection autonome, mieux adapté aux particularités de leur situation. L’évolution de la notion de « protection internationale » par le biais de l’interaction entre les différents régimes de protection de la personne permet la déconnexion de la recherche d’asile du statut de réfugié et l’adoption d’une approche fonctionnelle plus que formelle en la matière. Ceci ouvre la voie à l’autonomisation conceptuelle du demandeur d’asile et à l’identification d’un statut juridique qui lui soit propre.
